Zindle is a service operated by DS Webhosting Services (ABN 42 988 054 565) ("Zindle", "we", "us"), an Australian business. These Terms govern your use of the Zindle HTML-to-PDF rendering service at zindle.com.au and its API. By creating an account or using Zindle, you agree to these Terms. If you do not agree, please do not use the service.

Who we are

Zindle is operated by DS Webhosting Services (ABN 42 988 054 565). Billing for Zindle is handled under DS Webhosting's payment-processing arrangements with Stripe. Where these Terms say "we" or "us," they mean DS Webhosting Services operating the Zindle service.

Acceptance of terms

By accessing or using Zindle, you agree to be bound by these Terms. Continued use after changes to these Terms constitutes acceptance of the revised Terms.

The service

Zindle is an API that converts HTML you submit into PDF documents. You send markup (and optional rendering options); we render it and return a PDF. Your document content is processed to produce your result and is not stored (see our Privacy Policy). We may modify, suspend, or discontinue any part of the service at any time, with reasonable notice where practical.

Accounts

To use Zindle you must create an account. You agree to:

  • provide accurate, current, and complete information;
  • maintain the security of your account credentials and API keys;
  • notify us promptly of any unauthorised use of your account or keys;
  • be responsible for all activity that occurs under your account.

You are responsible for keeping your API keys confidential. Activity authenticated with your keys is treated as your activity.

Acceptable use

When using Zindle, you agree not to:

  • use the service for any unlawful purpose or in violation of any applicable Australian or international law;
  • submit, render, or distribute content that is unlawful, defamatory, infringing, obscene, or otherwise harmful;
  • use the service to infringe the intellectual property or privacy rights of others;
  • attempt to use the service to access, attack, scan, or probe systems or networks you are not authorised to access (including using the rendering or asset-fetching features to reach internal or third-party systems);
  • attempt to gain unauthorised access to Zindle's systems, other accounts, or the underlying infrastructure;
  • exceed, evade, or interfere with the usage limits, quotas, or rate limits of your plan, or attempt to circumvent metering;
  • use the service in a way that disrupts or degrades its performance or that of other users;
  • resell or redistribute the service without our prior written agreement.

You are solely responsible for the content you submit for rendering and for ensuring you have the right to use it. We reserve the right to suspend or terminate access, without notice in serious cases, where we reasonably believe these Terms have been breached.

Plans, quotas, and billing

Zindle is offered on a free tier and one or more paid subscription tiers. Current plans, prices, and monthly render quotas are shown on our pricing page.

  • Billing. Paid plans are billed monthly in advance through Stripe. Charges may appear on your statement as ZINDLE and on your receipt as a DS Webhosting transaction for the relevant Zindle plan.
  • Quotas. Each plan includes a monthly render allowance. Usage is metered; exceeding your plan's allowance may result in requests being declined until the next period or until you upgrade.
  • Keeping payment current. You are responsible for ensuring your payment details remain valid. Failure to maintain valid payment may result in suspension or termination of the paid service.
  • Cancellation. You may cancel at any time. Cancellation takes effect at the end of your current billing period, and you retain access to your paid plan until then.
  • Refunds. Paid fees are non-refundable except where required by law (see Limitation of liability). In particular, if we are unable to provide the service you have paid for, you are entitled to a remedy as required by the Australian Consumer Law. We do not otherwise provide pro-rata or partial refunds for cancellation part-way through a billing period; instead, you keep access until the end of the period you have paid for.

We may change plans and prices from time to time. Changes to the price of an existing subscription will be notified in advance and will take effect from a future billing period.

Third-party services

Zindle relies on third-party providers, including Stripe (payment processing) and the login providers you choose to authenticate with (such as Google or GitHub). Your use of those services may also be subject to their own terms. We are not responsible for the acts, omissions, or service levels of third-party providers, though we will make reasonable efforts to help resolve issues arising from their services where they affect you.

Intellectual property

The Zindle name, branding, logos, website, documentation, and software are the property of DS Webhosting Services, unless otherwise stated. You may not reproduce, redistribute, or use this material for commercial purposes without our prior written permission.

Content you submit to the service (the HTML you render) remains your property. You grant us only the limited, temporary licence necessary to process that content in order to generate and return your PDF. We do not retain your content after the render is complete.

Availability

We make reasonable efforts to keep Zindle available and operating reliably, but we do not guarantee uninterrupted or error-free operation, and we do not currently offer a formal uptime service-level agreement (SLA). Scheduled maintenance, third-party outages, or circumstances outside our reasonable control may result in temporary unavailability.

Limitation of liability

To the extent permitted by Australian law, DS Webhosting Services excludes all liability for any indirect, incidental, or consequential loss arising from your use of Zindle. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law that cannot lawfully be excluded. Where permitted by law, our liability for any loss or damage arising from the service is limited, at our option, to re-supplying the service or paying the cost of having it re-supplied.

You are responsible for the content you submit and for your own use of the PDFs you generate. We are not liable for the content of documents you render or for how you use them.

Termination

You may stop using Zindle and cancel your subscription at any time. We may suspend or terminate your access, with or without notice, where we reasonably believe you have breached these Terms, where required by law, or where continued provision of the service is no longer commercially viable for us. Where practical, we will give reasonable notice before terminating an ongoing paid service. On termination, your right to use the service ends; provisions that by their nature should survive (such as intellectual property, liability, and payment obligations already incurred) will survive.

Changes to these terms

We may update these Terms from time to time to reflect changes in our service, legal requirements, or business practices. The "Last updated" date above reflects the most recent revision. Continued use after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of the service are subject to the exclusive jurisdiction of the courts of Victoria, Australia.
